1. What Noble Hands is — and is not
Noble Hands provides non-clinical, in-home personal care and support services for senior citizens in Kolkata, including attendant care, companionship, accompaniment assistance, and check-in visits. Our caregivers are directly engaged, trained, and managed by Noble Hands.
Noble Hands is not a hospital, nursing home, clinical establishment, diagnostic centre, or medical service provider. We do not provide medical advice, diagnosis, or treatment. Nothing on our website or communicated by our caregivers or staff should be treated as medical advice.
Where a family requests nursing or physiotherapy, Noble Hands coordinates such visits through independent, vetted, qualified practitioners on a per-visit basis. These practitioners are solely responsible for the clinical services they provide, act under their own professional registration and judgement, and are not employees of Noble Hands. Noble Hands' role is limited to introduction, scheduling, and coordination.
Noble Hands is not an emergency service. In a medical or other emergency, contact appropriate emergency services immediately.
2. Eligibility and bookings
You must be at least 18 years of age to book services or enter into an agreement with us. Where you book care for another person (such as a parent), you confirm that you are authorised to do so on their behalf and that you will share relevant information about their needs honestly and accurately.
Bookings may be made through our website, through our contact form, or via WhatsApp. A booking is confirmed only when Noble Hands confirms it in writing (including by WhatsApp or email). We may decline or discontinue a booking where the care needs fall outside our scope, where the environment is unsafe for our caregivers, or on other reasonable operational grounds.
3. Services, pricing, and payment
Service descriptions and prices are published in our service catalogue and are fixed as published; applicable taxes are additional unless stated otherwise. We may revise prices with reasonable prior notice; revised prices apply to new bookings and renewals, not to visits already paid for.
Payment is due as specified at booking — per visit, or in advance for service packages. Pre-paid packages are governed by these Terms and our Cancellation & Refund Policy. We may suspend services where payment is overdue after reasonable notice.
4. Your responsibilities
You agree to:
- provide accurate, complete information about the care recipient's needs, home environment, and any known risks (mobility, memory, infection, aggression, pets, and similar);
- provide a reasonably safe, respectful working environment for caregivers, free of harassment, abuse, or unlawful demands;
- not ask caregivers to perform tasks outside the agreed scope, including clinical or medical tasks, heavy household labour, or work for persons other than the agreed care recipient;
- not hand over cash, valuables, ATM cards, or financial instruments to caregivers except through a process we formally document; and
- inform us promptly of any concern, incident, or change in circumstances.
We may withdraw a caregiver and suspend or terminate services immediately where a caregiver's safety or dignity is at risk.
5. Our caregivers and non-solicitation
Caregivers are assigned, scheduled, replaced, and managed by Noble Hands at our discretion. Your service agreement is with Noble Hands, not with any individual caregiver. We will always try to maintain continuity, but we do not guarantee a specific individual for any visit.
Non-solicitation: During your engagement with Noble Hands and for 12 months after it ends, you agree not to directly or indirectly employ, engage, or pay any Noble Hands caregiver (or panel practitioner introduced by us) for care or related services outside Noble Hands. If you wish to engage a caregiver directly, contact us; any such arrangement requires our written consent and a placement fee of ₹25,000.
6. Cancellations, refunds, and service delivery
Cancellations, rescheduling, refunds, and the manner of service delivery and scope changes are governed by our Cancellation & Refund Policy and Shipping, Service Delivery & Exchange Policy, which form part of these Terms.
7. Limitation of liability
To the maximum extent permitted by law:
- Noble Hands' total aggregate liability arising out of or relating to the services shall not exceed the amount paid by you to Noble Hands for the services giving rise to the claim in the 3 months preceding the event;
- Noble Hands is not liable for indirect, incidental, or consequential loss;
- Noble Hands is not liable for the acts, omissions, advice, or clinical services of independent panel practitioners (nurses, physiotherapists, or other professionals), who remain solely responsible for their professional services; and
- Noble Hands is not liable for delay or failure caused by events beyond our reasonable control, including strikes, bandhs, extreme weather, or public-health restrictions.
Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnity
You agree to indemnify Noble Hands against claims and losses arising from your breach of these Terms, from materially inaccurate information you provide about the care recipient or home environment, or from unlawful conduct toward our caregivers or staff.
9. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. Once care begins, our Care Services Privacy Notice also applies and is provided at onboarding.
10. Website use and intellectual property
The Noble Hands name, logo, website content, training materials, and service documentation are the property of Noble Hands Private Limited. You may not copy, reproduce, or use them except as needed to use our services. You agree not to misuse the website, attempt to disrupt it, or submit false or automated form entries.
11. Suspension and termination
Either party may end an ongoing service arrangement in accordance with the Cancellation & Refund Policy. We may suspend or terminate immediately for non-payment, safety concerns, abusive conduct, breach of the non-solicitation clause, or unlawful demands, without prejudice to amounts already due.
12. Changes to these Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new "last updated" date. Continued use of the services after an update constitutes acceptance. Material changes affecting active paid packages will be notified to you.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Courts at Kolkata, West Bengal shall have exclusive jurisdiction, subject to any mandatory consumer-protection rights you hold under the Consumer Protection Act, 2019.
